Demi Moore and Ashton Kutcher Divorce: Prenup?

Demi Moore and Ashton Kutcher may be headed for divorce, if the swirling reports prove true. But the real million-dollar (make that multi-million dollar) question is whether they have a prenup and what will happen if they don’t.

Yet another high-profile, Hollywood couple to perhaps fall victim to a split, amid cheating rumors involving an apparent bleach blonde lover, Moore, 48, and Kutcher, 33, have quite the fortune to divide and conquer if they do end up signing those divorce papers. While it’s not clear if the couple has a prenuptial agreement, Hollywood Life consulted with a leading divorce lawyer to get his insight on the dollars and cents of the situation should a prenup not be in the equation.

Paul Catsandonis, who hasn’t represented Demi Moore or Ashton Kutcher, hypothesizes that if and when they file, it will be in California, where that means a 50/50, right down the middle, money split—regardless of which person brought to the party the bigger income and assets.

Now he is the one with the controversy! Reportedly banking a sizeable $800,000 to $900,000 per episode, Kutcher may be facing a “what’s mine is yours” situation, as the lawyer confirmed the “income from his new sitcom will be considered marital property until someone files for divorce.”

And without a prenup, there may be more bad news for Ashton Kutcher, but also Demi Moore. “Ashton’s alleged affair also won’t affect the division of funds. If they didn’t sign a prenup, they can expect to split their worth in half.”

Wow, talk about going “halfsies”! But who will end up with the better half of the bargain should the split happen?
