According to Terry Frieden of CNN, the Obama Administration responded today to a lawsuit filed by the Thomas More Law Center, a conservative Republican law firm in Michigan, which stated it was unconstitutional for the Federal Government to compel its citizens to have health insurance.  This lawsuit named President Barack Obama, Health and Human Services Secretary Kathleen Sebelius, Treasury Secretary Timothy Geithner and Attorney General Eric Holder as defendants.

The Justice Department replied in its legal brief filed in Federal Court in Detroit, Michigan, “The health care industry operates in interstate commerce and there is a long recognized federal interest in its regulation.  In addition, the government stated an injunction to stop the health care law from being put into effect should not be given since the health insurance portion of the law does not take effect until January 1, 2014.”

Several state governments joined together in a similar lawsuit filed in Florida, which challenged the constitutionality of the Federal Government mandating health insurance coverage as well as the requirement  by states to provide coverage to additional low income people but without receiving any additional funding from the Federal Government.

I think it is unconstitutional for the Republicans to deny us of the right to health and happiness guaranteed by the CONSTITUTION…What do you think?
